EU: EDPB adopts Guidelines on Right of Access

The European Data Protection Board ('EDPB') announced, on 19 January 2022, that during its 59th plenary session, which was held on 18 January 2022, it adopted the Guidelines on Right of Access ('the Guidelines'). In particular, the EDPB stated that the Guidelines aim to analyse the various aspects of the right of access and to provide more precise guidance on how the right of access must be implemented in different situations. In addition, the EDPB highlighted that, among other things, the Guidelines provide clarifications on the scope of the right of access, the information the controller has to provide to the data subject, the format of the access request, the main modalities for providing access, and the notion of manifestly unfounded or excessive requests. Furthermore, the EDPB noted that the Guidelines will be subject to public consultation for a period of six weeks.
