EU: Belgian Market Court agrees CJEU ruling is needed before IAB Europe's TCF action plan validation assessment

Interactive Advertising Bureau (IAB) Europe announced, on September 7, 2023, that the Belgian Market Court had rendered an interim ruling and suspended its assessment of the Belgian Data Protection Authority's (Belgian DPA) validation decision in relation to the Transparency & Consent Framework (TCF), pending the Court of Justice of the European Union's (CJEU) preliminary ruling. In particular, IAB Europe explained that the Market Court's judgment demonstrates that the Belgian DPA's validation decision was taken too soon, as the Market Court explicitly indicated that the CJEU's ruling will have a bearing on the legality of the decision to validate IAB Europe's TCF action plan. 

IAB Europe welcomed the Market Court's judgment, noting that the same will allow the completion of the remaining legal proceedings, also removing the risk of introducing changes to the TCF that may ultimately be found inappropriate by the CJEU.
