Denmark: Digitaliseringsstyrelsen announces findings of investigation on 200 websites

On August 14, 2024, the Danish Digital Agency (Digitaliseringsstyrelsen) announced that it had found that among 200 randomly selected Danish websites all collected data without visitors' consent.

The Digitaliseringsstyrelsen stated that the 200 selected websites used tracking technologies, such as pixels and cookies, before visitors had the opportunity to give consent. Specifically, the Digitaliseringsstyrelsen found:

  • 42.2% of websites had unclassified cookies;
  • 27.6% of websites lacked information in their cookie banner; and
  • 18.1% of websites were missing a cookie banner.

Additionally, Digitalisringsstyrelsen provided that the service providers were requested to correct these deficiencies through consultation letters and 196 companies have corrected their use of tracking technologies. It also outlined that the companies that have not yet corrected their shortcomings may be reported to the police and may be issued a fine, depending on the nature of the violation.
