Denmark: Datatilsynet updates guidance on data protection in employment relationships
The Danish data protection authority ('Datatilsynet') announced, on 29 March 2023, that it had updated its guidance on data protection in the context of employment relationships. In particular, the Datatilsynet stated that following its last revision of the guidance in December 2020, it has updated the guidance in light of its latest practices, including those on obtaining criminal records and references. In this regard, the Datatilsynet noted that it has clarified a number of sections in the guidance, including that on the employer's duty to provide informaiton and on the disclosure of personal data. Lastly, the Datatilsynet stated that the structure of the guidance has also been adjusted to make it easier to read and more useful.
