Denmark: Datatilsynet publishes cookie guide

The Danish data protection authority ('Datatilsynet') published, on 12 February 2021, a quick guide for the use of cookies, together with the Danish Council for Digital Security and the Danish Business Authority. In particular, the guide outlines a number of requirements for the use of cookies, including that: 

  • a positive action must have taken place in order for consent to be deemed valid;
  • users must be provided with an equal opportunity to accept and decline the use of cookies;
  • there must be clear information regarding the purpose and expiration of the cookies;
  • consent must be obtained before cookies are set;
  • users must be able to easily withdraw their consent;
  • only necessary cookies can be set before consent has been obtained;
  • consent must be documented; and
  • any alternative legal bases used for the subsequent processing of personal data should be stated in the cookies declaration/privacy notice.
