Czech Republic: Whistleblowing bill referred to Chamber of Deputies

The Ministry of Justice announced, on 16 March 2023, that the draft Bill on the Protection of Whistleblowers transposing the Directive on the Protection of Persons who Report Breaches of Union Law (Directive (EU) 2019/1937) ('the Whistleblowing Directive') is being considered in the Chamber of Deputies at second reading, and is expected to be approved in 2023. In particular, the Ministry stated that the bill was approved by the Government of the Czech Republic, on 23 November 2022, and thereafter referred to the Chamber of Deputies on 30 November 2023. Further, the Ministry of Justice noted that the bill was first read on 12 January 2023, following which the Constitutional and Legal Committee promptly reviewed the bill, issuing recommendations on 2 March 2023.

Despite missing the initial transposition deadline of 17 December 2021, the Ministry of Justice highlighted that, under the leadership of the Minister of Justice, Pavel Blažek, it has started applying the Whistleblowing Directive's direct vertical effect, allowing individuals to claim their rights under the Whistleblowing Directive directly against the state.
