Cyprus: Commissioner issues notice on results of cookie audit
The Office of the Commissioner for Personal Data Protection published, on 8 May 2023, a notice regarding the audit it has been carrying out regarding the use of cookies. In particular, the Commissioner noted that it had completed 30 audits which mainly concern news and other relevant public information websites. To this end, the Commissioner noted that the main issues found during the audit include:
- there was no information about the purposes of using cookies;
- websites that had information about the use of cookies did not receive the express consent of the users for the use of cookies, or their method of obtaining consent did not meet the conditions for legal consent; and
- some cookies, such as those used to measure website traffic, were incorrectly categorised as 'absolutely necessary'.
Furthermore, the Commissioner provided that it is monitoring and participating in discussions of the groups of the European Data Protection Board ('EDPB') that examine various issues in relation to the use of cookies, noting that, if necessary, it will carry out additional checks on the matters under discussion, such as the use of Google Analytics and Facebook connect/pixel tools, as well as other new technologies.
