China: CAC requests comments on draft provisions on Internet thread commenting services

The Cyberspace Administration of China ('CAC') requested, on 17 June 2022, public comments on the draft Provisions on the Administration of Internet Thread Commenting Services. In particular, the CAC highlighted that the draft provisions apply to apps and websites with public opinion attributes that provide users with means to, among other things, post, reply, and leave messages. More specifically, the draft provisions establish obligations on service providers to protect users' personal information, following the principles of legality, legitimacy, and integrity. In addition, the draft provisions state that service providers must publicise the personal information processing rules, including the processing purpose, type of personal information processed, and the storage period of the personal information concerned.

Furthermore, the draft provisions outline that the real identity of users must be authenticated, and service must not be provided to users who have failed to authenticate their identity.
