California: Bill relating to health information passes Senate

Assembly Bill 352 on Health information was read for a third time and passed by the California State Senate on September 13, 2023, and was ordered on the same day to the California State Assembly for concurrence with the amendments introduced by the Senate. 

The bill outlines requirements for applicable entities which include providers of healthcare, pharmaceutical companies, or contractors who create, maintain, preserve, store, abandon, destroy, or dispose of medical information. In addition, the bill seeks to provide patients with a right to access or receive a copy of their electronic medical records upon request which must be consistent with applicable state and federal laws governing the same.
