California: Bill on exemptions for abortion services under CCPA introduced to Assembly
Assembly Bill 1194 for An act to amend Sections 1798.99.31, 1798.145, and 1798.185 of the Civil Code, relating to privacy was introduced, and read for the first time, on 16 February 2023, in the California State Assembly. In particular, the bill seeks to amend the California Consumer Privacy Act of 2018 ('CCPA'), where the same requires businesses to delete personal information about the consumer, unless this would restrict a business' ability to, among other things, comply with federal, state, or local laws, or comply with a court order or subpoena to provide information, or cooperate with a Government agency request for emergency access to a consumer's personal information if a natural person is at risk or danger of death or serious physical injury.
Further to this, the bill would specify that a consumer accessing, procuring, or searching for services regarding contraception, pregnancy care, and prenatal care, including, but not limited to, abortion services, does not constitute 'a natural person being at risk or danger of death or serious physical injury'.
