Assembly Bill ('AB') 2273 for the California Age-Appropriate Design Code Act passed, on 26 May 2022, the State Assembly and will now be considered in the State Senate. In particular, the bill would require that companies which develop and provide online services, products, or features that can be accessed by children consider the best interests of children when designing, developing, and providing such services, products, or features. In addition, the bill would require companies to undertake a Data Protection Impact Assessment ('DPIA') in certain cases, to configure all default privacy settings to a high level of privacy protection, and would provide for requirements around privacy policies, as well as outlining prohibited activities.
