Brazil: Ministry of Economy publishes ordinance on sharing of personal data with third parties
The Ministry of Economy published, on 19 April 2022, Ordinance No. 167 authorising the Federal Service for Data Processing ('SERPRO') to provide third parties with access to data subject's personal data, under the management of the Special Secretariat of the Federal Revenue Service of Brazil ('RFB'). In particular, the Ordinance aims to facilitate the access to data subjects' personal data in order to complement public policies which provide information to society through technological solutions which are complementary to those offered by the RFB.
Moreover, the Ordinance addresses topics such as:
- the costs required to maintain the computerised systems necessary to provide access to personal data, where costs would be reimbursed to SERPRO by the third parties interested in purchasing such data; and
- ensuring the implementation of an institutional risk identification process or risk to the confidentiality of the individual or legal entity to which the data refers.
