Brazil: Bill seeking immediate application of LGPD enforcement introduced to Chamber
Bill No. 578/2021 amending Law No. 13.709 of 14 August 2018, General Personal Data Protection Law (as amended by Law No. 13.853 of 8 July 2019) ('LGPD') to implement the immediate application of the enforcement provisions of the LGPD was introduced, on 24 February 2021, to the Chamber of Deputies. In particular, the bill would amend Article 65 of the LGPD so that fines under the LGPD would take effect immediately, rather than on the current effective date of 1 August 2021. Furthermore, the justification of the bill highlights that sanctions should apply now in order to immediately respond to the social demand to face the exponential growth of digital data traffic due to the pandemic, which creates a favourable environment for increased improper conduct.
