Brazil: ANPD publishes study on data processing for academic purposes and performance of studies by research bodies
The Brazilian data protection authority ('ANPD') published, on 3 May 2022, its technical study on the processing of personal data for academic purposes and the performance of studies by a research body under Law No. 13.709 of 14 August 2018, the General Personal Data Protection Law (as amended by Law No. 13.853 of 8 July 2019) ('LGPD'), and is seeking comments on the same.
In particular, the ANPD's study seeks to establish, among other things:
- parameters that can guide both teaching and research institutions that process personal data and public entities and bodies responsible for analysing access requests and making personal data available for scientific research purposes;
- the process of personal data processing for academic purposes and for carrying out studies and research, including practical aspects regarding access and sharing of personal data for research purposes; and
- subsidies for future decision-making by the ANPD, through the establishment of more conclusive interpretations and guidelines.
Comments on the study can be sent to the ANPD Ombudsman, through Fala.BR, until 6 June 2022.
