Brazil: ANPD publishes guidance on new form for sending security incident reports

The Brazilian data protection authority's ('ANPD') Inspection General Coordination published, on 23 December 2022, a new form for sending security incident reports by data controllers to the ANPD. In particular, the ANPD noted that the new form must be used for security incidents from 1 January 2023 onwards. Moreover, the ANPD highlighted that the new form was developed to facilitate the filling-in of the new form by data controllers, as well as the analysis of incident reports by the ANPD. Specifically, the ANPD outlined that the new form expands on the use of structured responses and guidance on the incident reporting process, which was also included in the body of the form.

Furthermore, the ANPD emphasised that the form should be sent in PDF format through the Electronic Petition of the Single System of Electronic Process in Network. In addition, the ANPD clarified that the new form should only be used for reporting incidents by data controllers, otherwise the ANPD reporting channel should be used.
