Brazil: ANPD and CADE sign technical cooperation agreement

The Brazilian data protection authority ('ANPD') signed, on 2 June 2021, the Technical Cooperation Agreement No. 5/2021 ('the Agreement') jointly with the Administrative Council for Economic Defense ('CADE') in order to establish coordinated actions in cases of infringement of the economic order involving personal data and for the dissemination of the culture of free competition in services that ensure the protection of personal data. Furthermore, the agreement highlights guarantees of effective control that the data subjects must have over their data and how personal data is being used by data controllers and processors in specific processing activities.

Moreover, to achieve the agreement purpose, the ANPD and CADE will carry out activities such as:

  • sharing documents, studies, research, and information;
  • conducting periodic meetings, workshops, and technical visits;
  • trainings;
  • cooperation in transfer concentration acts or other types of data processing; and
  • cooperation in cases of infringement of the economic order involving personal data.
