Berlin: Berlin Regional Court dismisses €14.5M fine proceedings against Deutsche Wohnen
Deutsche Wohnen SE announced, on 23 February 2021, that the Regional Court in Berlin had dismissed the €14.5 million fine proceedings against the company for General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR') violations, finding the notice of the fine to be ineffective. In particular, Deutsche Wohnen stated that the Berlin data protection authority ('the Berlin Commissioner') had issued the fine following an on-site investigation which found that, between May 2018 and March 2019, Deutsche Wohnen had failed to adequately implement measures to enable the regular deletion of tenant data that is no longer required. Furthermore, Deutsche Wohnen noted that the Berlin Commissioner can lodge an immediate complaint with the Chamber Court against the decision within one week.
