Beijing: Municipal CAC releases pilot free-trade zone data outbound negative list

On August 30, 2024, the State Council of the People's Republic of China announced that the Beijing Municipal Cyberspace Administration, Municipal Bureau of Commerce, Municipal Government Services, and Data Management Bureau jointly released the first scenario-based, field-level data outbound negative list entitled 'China (Beijing) Pilot Free-Trade Zone Data Outbound Management List (Negative List) (2024 Edition).'

Content of the negative list

The press release outlined that the negative list, among other things:

  • includes 48 items of data in five industries, including automobiles, medicine, retail, civil aviation, and artificial intelligence (AI);

  • distinguishes industry-specific regulatory requirements and reasonably sets the threshold for the amount of personal information that needs to be included in the assessment and filing based on the scenario; and
  • specifies in detail the list of data that needs to pass:
    • a data export security assessment under industry-specific circumstances; and
    • the registration of standard contracts for the export of personal information and the certification for personal information protection for export.

Implementation

The press release highlighted the implementation of four 'key implementation measures,' including:

  • the coordinated layout of the Beijing Data Cross-border Service Center;
  • the establishment and operation of four service stations in the Daxing Airport Airside Area, the Central Business District, the Beijing Economic and Technological Development Zone, and the Zhongguancun Science City;
  • optimizing government service functions, including their expansion; and
  • forming a 'one-stop' service capability for enterprises.
