Bavaria: BayLfD issues guide on data transfers for public authorities

On May 24, 2023, the Bavarian data protection authority (BayLfD) issued its guide titled 'International data transfers,' aimed at Bavarian public authorities. With numerous practical tips and case studies, the guide explains the requirements for cross-border transfers of personal data to third countries based on the current legal framework, outlining the relevant transfer mechanisms under Article 44 of the General Data Protection Regulation (GDPR).

More specifically, the guide discusses the position of the European Data Protection Board (EDPB) after the Schrems II decision, statements by the German Data Protection Conference (DSK), and the European Commission Draft Implementing Decision on the adequate protection of personal data under the EU-US Data Privacy Framework (EU-US DPF).
