Baden-Württemberg: LfDI Baden-Württemberg dismisses investigation into schools on use of MS 365, issues recommendations

The Baden-Württemberg data protection authority ('LfDI Baden-Württemberg') published, on 28 September 2022, a statement in which it dismissed the investigation into 40 schools on the use of MS 356 in schools. In particular, the LfDI Baden-Württemberg had requested, following the receipt of complaints on the use of the same in April 2022, evidence from the schools on a data protection-compliant use of the software. In this regard, the LfDI Baden-Württemberg specified that 31 schools had stated that they had implemented changes to comply with data protection legislation, or will do so by the end of the first half of the 2022/23 school year.

Furthermore, the LfDI Baden-Württemberg recommended all schools to use the software in a way that complies with their data protection obligations and to provide evidence for implemented changes, stating that it will continue to investigate all specific complaints about the use of the software in schools.
