Austria: EDPB issues summary on DSB fining Österreichische Post €18 million

The European Data Protection Board ('EDPB') issued, on 23 October 2019, a summary ('the Summary') on the Austrian data protection authority's ('DSB') fine of €18 million in an administrative fine proceedings for violations of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR') committed by Österreichische Post. In particular, the DSB found that Österreichische Post had violated the GDPR by processing personal data on the alleged political affinity of affected data subjects. Moreover, the DSB held that Österreichische Post committed a further violation by processing data on package frequency and the frequency of relocations for the purpose of direct marketing.

In addition, the decision can still be challenged before the Federal Administrative Court.
