Argentina: Public consultations begins on the draft proposal for the Personal Data Protection Law

The Argentinian Government announced, on 12 September 2022, that public consultations have begun on the draft proposal for the Personal Data Protection Law. In particular, the Argentinian Government noted that the Agency for Access to Public Information ('AAIP') published Resolution AAIP 119/2022, which provides a framework for reforming the Personal Data Protection Act, Act no. 23.326 of 2000 ('the Act'). Furthermore, the Argentinian Government highlighted that the objective of the public consultation is to guarantee the effective participation of citizens in accordance with the provisions of the General Regulations for the Participatory Preparation of Norms, established in Annex V of Decree 1172/03.

The public consultation will be available from 12 September to 30 September 2022. Contributions and opinions can be submitted on the Agency for Access to Public Information's website.

Public consultation deadlines extended on the draft proposal for the Personal Data Protection Law

The Argentinian Government announced, on 30 September 2022, via it's resolution No. 145/2022 that the public consultation on the draft proposal for the Personal Data Protection Law has been extended from 12 September 2022 to 11 October 2022. In particular, the Argentinian Government noted that the AAIP had published Resolution AAIP 145/2022. Moreover, the Argentinian Government highlighted that during the consultation process it had received requests to extend the deadlines, in order to present proposals and opinions on the draft of the AAIP.

Furthermore, the Argentinian Government highlighted that it had received more than 70 proposals, and opinions had been received on the text of the preliminary draft of the Personal Data Protection Law, while 10 informal comments had been made and published on the website. In addition, the Argentinian Government reiterated that submissions can be made on the consultation form and that it can be presented at Ticket Desk, Av. Pte. Julio A. Roca 710 floor 3, Autonomous City of Buenos Aires, from 9 a.m. to 4 p.m

Public consultations have ended

The Argentinian Government announced, on 14 October 2022, that its public consultations ended on 11 October 2022. In particular, the Argentinian Government noted that it received more than 140 contributions and opinions from citizens, civil society organisations, universities and researchers, the private sector, and the national and international public sector. In addition, the Argentinian Government highlighted that it received a further 19 informal comments through the email address provided.

Furthermore, the Argentinian Government provided that the next stage is to analyse of all the contributions and opinions, in order to consolidate a report that allows progress in a definitive version of the draft for the updating of the Personal Data Protection Law.
