October 06, 2020
The Art of Privacy is the new video series from OneTrust DataGuidance exploring key privacy and data protection concepts with commentary from industry-leading voices. In this episode, Eduardo Ustaran, Global Co-head of the Hogan Lovells Privacy and Cybersecurity Practice, discusses the fundamentals of Privacy by Design.
Eduardo explores some of the key challenges and benefits of Privacy by Design from the perspective of privacy professionals and highlights the core practical steps to achieve Privacy by Design. He also delves into the relationship between privacy professionals, the law, and how to enable more effective business processes through Privacy by Design.
Eduardo observes, "Privacy professionals over the years have become sort of Renaissance men and women that have to be good at everything. […] Privacy by Design is part of that, you have to understand the technology, you have to embed yourself in the development process, try to understand what the technology is trying to achieve and what the developers are trying to do, and contribute to that process."
Key features of Privacy by Design noted by Eduardo include:
- Identifying challenges/threats and responses
- Addressing principles
- Transparency
- Data minimisation
- Data security
- Implementing these within a design process
By emphasising the opportunities that privacy compliance can bring to organisations, Eduardo presents a positive approach to utilising Privacy by Design as a business enabler that lays the foundations for long term success. Eduardo underlines that a privacy professional's role is not to simply say 'you cannot do that' but that "the privacy professional should be there to say 'I know how you can do that'".
