What is a Transfer Impact Assessment?
Transfer Impact Assessments (TIAs) help organzations to assess the legal framework in a third country where personal data is being transferred. TIAs were introduced as part of the the European Data Protection Board's (EDPB) final guidance in the Schrems II case where, the EDPB outlined that organizations need to perform a TIA to evaluate the Article 46 transfer tool they rely on in light of the legal framework and practical application of the law in a third-country destination. In light of the adoption of the EU-US Data PRivacy Framework (EU-US DPF), TIAs are still a useful tool for assessing the risk to personal data when transferring to a country that does not hold an EU Adequacy Decision.
