The Politics of Data Protection
As always, Eduardo Ustaran, Partner at Hogan Lovells LLP, provides us with his editorial looking at the impact of global politics on the landscape of privacy compliance.
"Legal and regulatory matters tend to be complicated enough without the interference of politics. This means that as important as data protection has become for everyone's life, the way in which it is affected by politics makes it a notoriously difficult issue to grasp and manage in practice. Right now, crucial aspects of data protection compliance are in the hands of politicians and whether we like it or not, being an effective privacy and data protection professional also involves being a political pundit."
Cybersecurity Maturity Model Certification
Alex Sharpe of Sharpe Management Consulting LLC addresses what the Cybersecurity Maturity Model Certification ('CMMC') does not cover that may be critical to keeping your business, your customers, and your partners secure.
"Never forget, being compliant does not mean you are secure. The news is full of stories about breaches where this fundamental mistake was made. Do what you need to be compliant with the CMMC and whatever else you may be subject to, but never forget to ask the question: 'Is this sufficient to protect my business, my customers, and my business partners?'"
Building trust through data protection practices
As part of the new OneTrust DataGuidance video series, The Art of Privacy, Matthias Glatthaar, Head of Data Privacy and Digital at Migros- Genossenschafts-Bund discusses the challenges of building people's trust through effective data protection practices.
"The gap between the growing complexity of data processing and people‘s actual understanding of these mechanics is widening, and it is now more important than ever to invest in trust building measures. Today, building trust should be one of the most important goals in data privacy."
Data protection in Hong Kong
In October 2019, OneTrust DataGuidance met with Stephen Kai-Yi Wong, Commissioner at The Office of The Privacy Commissioner for Personal Data, Hong Kong, as part of the Regulator Spotlight interview series. Mr. Wong discussed the organization's recent work regarding enforcement, ethics, accountability, and Privacy by Design.
"We have a few, very challenging investigations to undertake, and we had the very long course of investigation because of the troops of lawyers behind all these parties. That gave my colleagues a testing and very trying time, because they have to deal with all sorts of questions and legal issues to resolve. The key takeaways arising out of the result of the investigation will be, I would say, most senior management members of the corporations that we have investigated did not take data protection seriously."
