USA: OSHA updates investigation manual for handling retaliation complaints under whistleblower statutes

The Occupational Safety and Health Administration ('OSHA') announced, on 11 August 2022, that it had updated its manual for the handling of retaliation complaints under whistleblower statutes. In particular, OSHA noted that the key changes in the manual include that formal investigative correspondence, including notifications and determinations, may now be sent by email with a delivery receipt, and notification letters to complainants must include a copy of the complaint. More generally, OSHA highlighted that the manual was restructured such that Chapter 2 now collects and explains the legal concepts and principles that guide whistleblower investigations.
