USA: FTC finalises settlement with Ortho-Clinical over allegations of misrepresentation of participation in Privacy Shield

The Federal Trade Commission ('FTC') announced, on 13 July 2020, that it had finalised a settlement ('the Settlement') with Ortho-Clinical Diagnostics, Inc. over allegations that it had misled consumers about its participation in the EU-US Privacy Shield ('the Privacy Shield'), even after its certification had lapsed in 2018. In particular, the Settlement prohibits Ortho-Clinical from continuing to misrepresent its participation in the Privacy Shield, as well as any other privacy or data security program sponsored by a government or a self-regulatory or standard-setting organisation. In addition, the Settlement outlines that Ortho-Clinical must comply with the continuing obligation under the Privacy Shield with regards to any personal information it collected during its participation in the Privacy Shield by protecting the personal information, or returning or deleting it.
