USA: EPIC submits comments to Colorado AG on proposed rule-making under the CPA

The Electronic Privacy Information Center ('EPIC') announced, on 5 August 2022, that it had submitted comments to the Colorado Attorney General ('AG') urging them to draft protective rules while implementing the Colorado Privacy Act ('CPA').

More specifically, EPIC urged the AG to, among others:

  • set out clear standards for personal data processing which restrict behavioural tracking of the data;
  • provide a definition for dark patterns which includes a non-exhaustive list of manipulative design tactics;
  • establish a universal opt-out mechanism; and
  • define minimum requirements for Data Protection Impact Assessments ('DPIAs') enabling objective review by enforcement authorities and consumers.
