USA: EPIC files complaint with FTC against HireVue over alleged unfair and deceptive practices

The Electronic Privacy Information Center ('EPIC') announced, on 6 November 2019, that it had filed a complaint ('the Complaint') with the Federal Trade Commission ('FTC'), alleging that HireVue, Inc. had committed unfair and deceptive practices, in violation of the Federal Trade Commission Act of 1914. In particular, the Complaint alleges that HireVue had used facial recognition technology to evaluate and make assessments on job applicants, and assessments would then be provided to companies to help streamline recruitment decision-making processes. In addition, the Complaint alleges that HireVue had failed to show that its practices meet the minimal standards for AI-based decision-making set out in the Organisation for Economic Co-operation and Development's artificial intelligence ('AI') principles or the recommended standards set out in the Universal Guidelines for AI.
