Turkey: KVKK publishes recommendations when processing personal data using AI

The Personal Data Protection Authority ('KVKK') published, on 15 September 2021, recommendations for the protection of personal data within the scope of the Law on Protection of Personal Data No. 6698 for developers, manufacturers, service providers, and decision makers operating in the field of artificial intelligence ('AI'). Moreover, the KVKK general recommendations, amongst others, include:

  • during the development and implementation of AI applications, the fundamental rights and freedoms of the persons concerned should be respected and violations of rights should not be allowed; and
  • the protection of human rights and fundamental freedoms and the right to the protection of human dignity must be respected.

Furthermore, the KVKK advises developers, manufactures, and service providers, amongst other things, the following:

  • in the design, an approach based on personal data privacy, consistent with national and international regulations and/or documents, should be observed;
  • a prudent approach should be adopted based on appropriate risk prevention and mitigation measures, taking into account the potential negative consequences for fundamental rights and freedoms; and
  • minimum data usage should be made by evaluating the quality, nature, source, amount, category, and content of the personal data used.
