Thailand: PDPC launches consultation period on rules for cross-border transfer of personal data

The Personal Data Protection Committee ('PDPC') opened, on 29 September 2022, for public hearing, its draft Notification of the Personal Data Protection Committee on Rules and Principles of Appropriate Personal Data Protection for International Transfer. In particular, the draft Notification sets out definitions for key terms, including transfer of personal data, Binding Corporate Rules ('BCRs'), and Standard Contractual Clauses, and establishes provisions on the functioning of BCRs and on appropriate safeguards for transfers. Moreover, the draft Notification, under Appendixes A and B, lays downs principles that govern data transfers outside Thailand, and qualify said principles as requirements.

The public hearing will close on 24 October 2022.
