Tennessee: Bill requiring disclosure on AI-generated content referred to Senate Commerce and Labor Committee

On March 6, 2024, Senate Bill 2431, a companion bill of House Bill 2707, was referred to the Tennessee Senate Commerce and Labor Committee following its introduction on January 31, 2024.

In particular, the bill would require individuals or entities to include a disclosure on the following types of content when it is generated using artificial intelligence (AI):

  • images, videos, or audio recordings, including songs, using the likeness of another individual; or

  • literature or other written work, including news stories, when the literature or other written work is written by an individual other than the individual listed as the author.

Furthermore, the bill provides that violations could result in the court issuing an injunction and award actual damages, punitive damages, and reasonable attorneys' fees and court costs.

The bill, if enacted, would apply from July 1, 2024.
