Spain: AEPD publishes checklist to determine formal adequacy of DPIA and presentation of prior consultation

The Spanish data protection authority ('AEPD') published, on 17 February 2022, a checklist to determine the formal adequacy of a Data Protection Impact Assessment ('DPIA') and the presentation of prior consultation. Moreover, the AEPD noted that the checklist complements its risk management and DPIA guide.

Furthermore, the AEPD highlighted that the checklist is intended to help those responsible to quickly identify and determine whether the DPIA process and documentation contains all the minimum elements expected of a DPIA. In addition, the AEPD emphasised that compliance with the checklist will allow those responsible to formally ensure that the request for prior consultation made in relation to a DPIA is in compliance with the requirements of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR').
