Slovenia: Commissioner publishes statement on Brexit

The Information Commissioner ('the Commissioner') published, on 7 January 2021, a statement highlighting that data flows may continue freely from the EU to the UK, following the signing of the EU-UK Trade and Cooperation Agreement, which provides for a clause that ensures the continuity of transfers of personal data between the EU (including the EEA) and the UK for a maximum period of six months. In addition, the Commissioner noted that the agreed period will automatically expire on 30 June 2021 or earlier if the European Commission adopts an adequacy decision for the UK in accordance with Article 45 of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'). Lastly, the Commissioner advised companies transferring personal data to the UK to closely monitor developments in this area.
