Slovakia: ÚOOÚ announces updated Opinion on obtaining consent
The Office for the Protection of Personal Data for the Slovak Republic ('ÚOOÚ') announced, on 9 November 2022, that, together with the Office for the Regulation of Electronic Communications and Postal Services ('RÚ'), it had published the updated Opinion on obtaining consent according to the provisions of Section 109(8) of the Act no. 452/2021 Coll. on electronic communications.
In particular, the ÚOOÚ provided that the Opinion explains how to set cookie bars for obtaining consent for cookies in accordance with the requirement of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR'). Moreover, the ÚOOÚ highlighted that the supervisory authority in the area of cookies is the RÚ. Furthermore, the Opinion provides that not only does it apply to cookie files, but it also applies to any other tools based on storage and the need to access the user's end device that are currently used by website operators, i.e. fingerprinting and web beacon.
