Saxony: SächsDSB publishes guidelines for municipalities and administrations on the provision of information under Article 15 of the GDPR
On August 1, 2024, the Saxon data protection authority (SächsDSB) published guidelines for municipalities and administrations on the provision of information under Article 15 of the General Data Protection Regulation (GDPR).
SächsDSB outlined that guidelines are aimed at public bodies in Saxony that are responsible within the scope of the GDPR and are based on Guidelines 01/2022 on data subject rights - Right of access of the European Data Protection Board (EDPB) and the case law of the Court of Justice of the European Union (CJEU).
The guidelines include information on:
- sending confirmation of receipt;
- checking and calculating the deadline;
- clarification of the identity and eligibility of the applicant, including verification through IDs and making copies;
- examination of whether there is an obligation to provide information and its extent;
- examination of an exception or restriction;
- form of providing information; and
- legal remedies.
