Rhineland-Pelatinate: LfDI Rheinland-Pfalz clarifies data protection necessity of guest access
On August 28, 2024, the Rhineland-Palatinate data protection authority (LfDI Rheinland-Pfalz) published a press release on the data protection necessity of guest access.
Information campaign
The press release follows an information campaign launched by the LfDI Rheinland-Pfalz with more than 100 online shops in August 2024 where 13 companies with deficiencies were identified and informed about the need to provide guest access for the ordering process.
Guest accounts
The LfDI Rheinland-Pfalz recognized the benefits of creating a customer account that lasts beyond the individual purchase, such as removing the need to re-enter the data and view previous orders.
However, the LfDI Rheinland-Pfalz outlined that:
- customers must be able to freely decide whether to store their data in the online shop, thus, guest orders must always be an equivalent alternative; and
- the obligation to offer guest access for online orders arises from Articles 5 and 6 of the General Data Protection Regulation (GDPR).
