Portugal: CNPD issues opinion on draft consumer rights law

The Portuguese data protection authority ('CNPD') announced, on July 2021, that it had issued an opinion on the Draft Decree-Law No. 1049/XXII/2021 ('the Draft Law'), which regulates consumer rights in the purchase and sale of digital goods, content, and services transposing the Directive on contracts for the sale of goods (Directive (EU) 2019/771) and the Directive on contracts for the supply of digital content and services (Directive (EU) 2019/770). In particular, the CNPD recommended that Article 3(3)(b) of the Draft Law should be redrafted to guarantee data subject rights and ensure that data subjects have appropriate redress. Additionally, the CNPD recommended that another section be added to the Draft Law to outline, in clear, direct, and easily understandable language, the application of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR') on the personal data processing activities of companies under the Draft Law.
