Portugal: CNPD issues guidelines on collection of employee health data during Coronavirus
The Portuguese data protection authority ('CNPD') issued, on 23 April 2020, its guidelines ('the Guidelines') on the collection of health data in the context of the COVID-19 ('Coronavirus') pandemic. In particular, the Guidelines note that health data is sensitive, as such data may reveal aspects of the employee's private life that do not need to be known by the employer but may also lead to discrimination. In addition, the Guidelines outline that an employer cannot collect and register the body temperature of employees or other information related to health or possible risk determining factors.
