Poland: UODO issues statement on electronic mail and unwanted advertising

The Polish data protection authority ('UODO') issued, on 6 July 2020, a statement on electronic mail and unwanted advertising. In particular, the statement highlights that an agreement is formed when a user signs up for receiving emails, and that consent must be express, meaning that the users should be informed by the controller about the specific purpose for which the data is to be processed, whether it is transferred to other entities, on what basis and for what purpose, and it must be able to be withdrawn at any time by the users. In addition, the UODO highlighted the right of data subjects to object to direct marketing under Article 21 of the General Data Protection Regulation (Regulation (EU) 2016/679) ('GDPR').
