Poland: UODO calls for improved supervision of telecommunications data control
On July 31, 2024, the Polish data protection authority (UODO) responded to a judgment by the Court of Justice of the European Union (CJEU) in case C-229/23 HYA as issued on June 13, 2024, by issuing an opinion that calls for changes in how state authorities handle operational control of telecommunications data.
The UODO highlighted that European law requires court rulings authorizing such control to include a written justification, which is currently lacking in Polish law. This inconsistency with European standards of privacy protection was also referenced by the UODO in a recent European Court of Human Rights (ECtHR) ruling of May 28, 2024, Pietrzak, Bychawska-Siniarska and others v. Poland (applications no. 72038/17 and 25237/18), which called for enhanced supervision of operational control practices in Poland.
