Peru: Ministry of Justice and Human Rights publishes draft regulations of law on personal data protection

On August 25, 2023, the Ministry of Justice and Human Rights announced the publication for public comment of the new draft Regulation of Law No. 29733 on Personal Data Protection. In particular, the draft aims to raise the regulatory standards for the protection of personal data compared to the previous regulations.

Among the novel aspects presented by the draft are:

  • the obligation to submit data breach notifications in case of security incidents affecting personal data;
  • new definitions, including 'personal data security incident' and 'profiling;'
  • the obligation to undertake a Data Protection Impact Assessment (DPIA) in certain situations; and
  • the introduction of the right to data portability.

The draft will be available to the public for a period of 30 days, during which interested stakeholders may provide their contributions, opinions, and suggestions via email at [email protected].
