Peru: Bill creating National Authority for Transparency, Access to Public Information and Protection of Personal Data approved

The Council of Ministers approved, on 9 June 2021, a bill that creates the National Authority for Transparency, Access to Public Information and Protection of Personal Data. In particular, the bill will be presented to the Congress of the Republic and integrates the current two authorities and the administrative court of transparency into a single national authority. Moreover, the bill amends Law No. 27806 on Transparency and Access to Public Information and Law No. 29733 on the Protection of Personal Data ('the Law') by granting the new authority the power to sanction public servants who disregard their obligations and violate the transparency and access to information regime. In addition, the Law is amended to establish, among other things, the right to data portability, the obligation for large companies that process and store personal data to have a personal data officer, and requirements to communicate security incidents.
