Norway: Datatilsynet announces temporary regulation on UK not being a third country for data transfers post Brexit

The Norwegian data protection authority ('Datatilsynet') announced, on 31 December 2020, that the Ministry of Local Government and Modernisation has adopted a temporary regulation stating that the UK will not be considered as a third country for the purposes of data transfers. In particular, the regulation notes that by means of an exception to the data transfer provisions in the Law on the Processing of Personal Data (Personal Data Act) of 15 June 2018, after 1 January 2021, transfers of personal data to the UK will not be considered as transfers to third states. In addition, Datatilsynet highlighted that Norwegian companies will be able to continue transferring data to the UK and that this temporary regulation will apply for no more than six months after the final trade and cooperation agreement between the UK and the EU has been approved by both parties.
