Northwest Territories: OIPC releases 2016-2017 annual report

The Office of the Information and Privacy Commissioner of the Northwest Territories ('OIPC') presented, on 3 October 2017, its 2016-2017 annual report ('the Report') to the Legislative Assembly of the Northwest Territories. The Report summarises the OIPC's investigations and legislative recommendations in relation to privacy legislation in the Northwest Territories, including the Health Information Act 2015 ('HIA').

In particular, the OIPC summarised investigations it had carried out in relation to health custodians, including the Yellowknife Health and Social Services Authority, and outlined several deficiencies in relation to the ability of custodian's electronic medical record systems to limit access to an individual's personal health information to specific individuals and record and the existence of conditions placed by a patient around the collection, viewing, use and disclosure of personal health information. Additionally, the OIPC expressed concern about the prevalence of data breaches in the health sector in the Northwest Territories, owing to the lack of sufficient data security safeguards, including encrypted email technology, put in place by health custodians.
