North Rhine-Westphalia: LDI NRW addresses processing of health data by schools

The North Rhine-Westphalia State Commissioner for Data Protection and Freedom of Information ('LDI NRW') released, on 20 April 2021, a statement on data protection principles, requirements, and limits when carrying out COVID-19 tests in schools. In particular, the LDI NRW highlighted that there must be a legal basis for processing health data and that the need for processing must be regarded as proportionate. Furthermore, the LDI NRW addressed the confidentiality of test results, record keeping requirements, and the transfer of test result information to third parties.
