New Zealand: OPC opens consultation on draft rules for the use of biometric technologies for businesses

On April 10, 2024, the Office of the Privacy Commissioner of New Zealand (OPC) announced that it had developed draft rules for the use of biometric technologies. In particular, the OPC highlighted that the new rules are targeted at organizations in New Zealand that are using biometric technologies.

What information did the OPC request from the public?

The OPC referenced the draft biometrics code and a consultation document that the public may refer to when considering the following questions:

  • proportionality - how should agencies have to demonstrate that the benefits outweigh the risks of biometrics before using them?
  • transparency - how and what should people be told when their biometrics is being collected?
  • limitations - what are some things that biometrics should not be used for?

Furthermore, the OPC noted that responses to the above-mentioned questions can be submitted via email to [email protected], until May 8, 2024.
