New Zealand: OPC dismisses case concerning disclosure of health information to child's representative

The Office of the Privacy Commissioner ('OPC') published, on 29 March 2021, a case note concerning the disclosure of health information to a child's representative. In particular, the OPC noted that a father had received funding from a disability support services provider to cover respite care for his child and that this information had been disclosed to the child's mother. In this regard, the OPC concluded that since the information falls within 'health information' under the Health Information Privacy Code 1994, the services provider is obliged to provide such information upon request to a child's representative, including the child's parents. As such, the OPC confirmed that there had been no breach of the Health Act 1956 and dismissed the father's complaints.
