New York: Bill on biometric privacy passed Senate

On June 6, 2024, Senate Bill S04457 for An Act to amend the general business law, in relation to biometric privacy passed the New York State Senate, was delivered to the Assembly, and was referred, on the same date, to the Consumers Affairs and Protection Committee.

The bill establishes the Biometric Privacy Act and introduces requirements for private entities in possession of biometric identifiers or biometric information, including to:

  • develop a written policy establishing a retention schedule and guidelines for permanently destroying biometric identifiers and biometric information;
  • inform the subject or their authorized representative in writing that such information is being collected or stored;
  • inform the subject or their authorized representative in writing of the specific purpose and length of term for which such information is being collected, stored, and used; and
  • receive a written release executed by the subject or their authorized representative.
