Nevada: Law on internet privacy enters into force
Senate Bill ('SB') 220 for an Act Relating to Internet Privacy entered, on 1 October 2019, into effect, after approval by the Nevada Governor, Steve Sisolak, on 29 May 2019. In particular, SB 220 prohibits an operator of an internet website or online service which collects certain information from consumers in Nevada from making any sale of certain information about a consumer, if so directed by the consumer. In addition, SB 220 revises the definition of the term 'operator' to exclude, among other things, financial institutions and entities that are subject to the Gramm-Leach-Bliley Act of 1999 and the Health Insurance Portability and Accountability Act of 1996, as well as a manufacturer of a motor vehicle or a person who repairs or services a motor vehicle who collects, generates, records or stores covered information. Finally, SB 220 authorises the Nevada Attorney General to seek an injunction or a civil penalty against an operator for potential violations.
